Payment & Billing policy

Charges and Payment of Fees

You shall pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. The initial charges will be equal to the current number of total Subscriptions requested, times the User Subscription fee currently in effect. Payment can be made using a Credit Card, PayPal or Invoice against Purchase Order. All payment obligations are non-cancellable and all amounts paid are non-refundable. You are responsible for paying for all User Subscriptions ordered for the entire Subscription Term, whether or not such User Subscriptions are actively used.

You must provide a valid credit card or approved purchase order information as a condition to signing up for the Service. An authorized Subscription Administrator may add Subscriptions by executing an additional written Order Form or using the Online Order Center. Added Subscriptions will be subject to the following: (a) added Subscriptions will be in accordance with the pre-existing Subscription Term (either Initial Term or renewal term); (b) the Subscription fee for the added Subscription will be the then current, generally applicable Subscription fee. Paramach reserves the right to modify its fees and charges and to introduce new charges at any time.

Billing and Renewal

All User accounts are billed in advance on the 1st day of the month. Subscribers that sign-up before the 1st day of the following month will be charged pro-rata from the sign-up date. (For example: If you sign-up on the 10th of June you will be charged in advance for the remaining 20 days of the month. Thereafter the normal billing cycle will begin, (1st July, 1st August, 1st September, etc.) Paramach will automatically renew and bill your credit card on the 1st day of the month, or issue an invoice to you against a Purchase Order, or other terms mutually agreed upon. The renewal charge will be equal to the then-current number of total User licenses times the license fee in effect during the prior term which shall be effective upon renewal and thereafter. Fees for other services will be charged on an as-quoted basis. Non-User accounts can be set up for separate Administrators or Billing Users such as a person(s) in an accounting department, and will not incur any monthly charges.

Paramach’s fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties. You agree to provide Paramach with complete and accurate billing and contact information. This information includes your legal company name, street address, e-mail address, and name and telephone number of an authorized billing contact and Subscription Administrator. You agree to update this information within 30 days of any change to it. If the contact information you have provided is false or fraudulent, Paramach reserves the right to terminate your access to the Service in addition to any other legal remedies, unless Paramach determines otherwise. If you believe your bill is incorrect, you must contact us in writing within 30 days of the invoice date, of the invoice containing the amount in question to be eligible to receive an adjustment or credit.

Excess Data Storage Fees

The maximum disk storage space provided to you is available from the Paramach.com web site. If the amount of disk storage required exceeds these limits, you will be charged the then-current storage fees. Paramach will use reasonable efforts to notify you when the average storage used per subscription reaches approximately 90% of the maximum; however, any failure by Paramach to so notify you shall not affect your responsibility for such additional storage charges. Paramach reserves the right to establish or modify its general practices and limits relating to storage of Customer Data.

Deactivate or Cancel Account

Should any subscriber wish to Deactivate or Cancel their subscription, he/she, can do so at any time. Active subscribers are paid up until the end of the billing month so the Subscriber will not be Deactivated or Cancelled immediately, just marked “Deactivation or Cancellation Pending”. At the end of the billing period, such subscribers will then be Deactivated or Cancelled immediately. We do not offer refunds, and we do not pro-rate for partial months. When an account is Deactivated all billing charges for such account(s) will be stopped immediately. Deactivated Users can still log in to their personal Dashboard area and access their projects and files, but will be unable to access the CAD/CAM application. Your contact information and billing details will be retained, should you wish to Reactivate the account. If you reactivate the account after suspension the normal billing cycle will begin as stated in the terms of this billing policy. If you wish to permanently Cancel the account, your billing details and any files stored on the paramach system will be deleted.

Non-Payment and Suspension

In addition to any other rights granted to Paramach herein, Paramach reserves the right to suspend or terminate this Agreement and your access to the Service if your account becomes delinquent (falls into arrears). Delinquent invoices (accounts in arrears) are subject to interest of 1.0% per month on any outstanding balance, or the maximum permitted by law, whichever is less, plus all expenses of collection. You will continue to be charged for User Subscriptions during any period of suspension. If you or Paramach initiates termination of this Agreement, you will be obligated to pay the balance due on your account computed in accordance with the Charges and Payment of Fees section above. You agree that Paramach may charge such unpaid fees to your credit card or otherwise bill you for such unpaid fees.

Paramach reserves the right to impose a reconnection fee in the event you are suspended and thereafter request access to the Service. You agree and acknowledge that Paramach has no obligation to retain Customer Data and that such Customer Data may be irretrievably deleted if your account is 30 days or more delinquent.
